A New Protection System for Landlords

The initiative, resulting from the agreement between Junts and PSOE, aims to guarantee landlords the payment of rent in case of tenant defaults. The aid will apply to contracts signed from the publication of the decree in the BOE and will be managed by the autonomous communities with state funding.

Even so, it is still necessary to approve the regulation that will detail the criteria and requirements for accessing the guarantees. The Spanish government has a period of six months to finalize these conditions.

What Do These Guarantees Cover?

Landlords will only be able to request the guarantee once they regain possession of the property, that is, when the tenant no longer resides there. From that moment, they will have six months to submit their application.

  • Debts arising from unpaid rent.
  • Damage caused by the tenant to the property.
  • Unpaid utilities that have had to be assumed by the landlord.
  • Other expenses determined by the regulation.

Who Can Access This Guarantee?

Landlords with properties located in high-demand rental areas must respect the established rental price limits to qualify for this coverage.

Additionally, the tenant must meet at least one of the following requirements:

  • Be under 35 years old.
  • Be in a situation of vulnerability recognized by the administration.

The decree also considers the possibility of including new groups as potential beneficiaries in future modifications of the measure.

To access the guarantee, it will be necessary to:

  • Deposit the legal deposit corresponding to the rental contract.
  • Formalize the commitment to participate in the program using the model that the administration will establish.

Conclusion

This new guarantee system aims to provide greater protection for landlords against non-payment and damages, but it remains to be seen how its implementation will unfold. With the regulation still pending development and divided opinions among different sectors, its real impact on the rental market will be determined in the coming months.
